1. Purpose and scope
These terms govern the use of the website neogenys.com and the acquisition of software published and distributed under license by NeoGenys. Any order implies acceptance without reservation.
They do not apply to service contracts, custom developments, projects, or deliverables carried out on behalf of clients. These assignments are subject to separate quotes, contracts, and specific terms negotiated on a case-by-case basis.
2. Publisher
The website and software are published by Steeven Thomas, a sole proprietorship registered under SIRET 81026190900040, based in Juillan (65), operating under the commercial name NeoGenys.

3. Products
NeoGenys publishes software distributed via download, intended for various uses depending on the product.
Each product page specifies the features, the intended use of the software, supported operating systems, system requirements, and, where applicable, any third-party software required for operation.
Announced features for upcoming products are indicative and may change until the product is made available.
4. Seller and order processing
Orders are processed by Creem, operated by Armitage Labs OÜ (Estonia), which acts as the official seller (merchant of record).
Creem is therefore the contracting party for the transaction. As such, Creem handles payment processing, issues invoices, collects and remits applicable VAT in the buyer’s country, and manages refund requests and chargebacks.
NeoGenys remains the software publisher and licensor as defined in Article 7.
Creem’s general terms and privacy policy apply to the transaction, in addition to these terms.
5. Pricing and payment
Prices are listed in euros. The exact amount, including applicable taxes based on the buyer’s country, is displayed before order confirmation on the payment page.
Launch offers and promotions are time-limited. The standard price applies after they expire.
6. Delivery
After payment confirmation, access to the download and, where applicable, the license key are sent by email to the address provided during checkout.
If the email is not received, buyers should first check their spam folder and then contact us via the contact form.
7. License to use
Purchasing the software does not transfer any ownership rights. It grants a personal, non-exclusive, non-transferable license to use the software for the purposes described on its product page, on the buyer’s devices.
Specifically prohibited are resale, rental, redistribution, public sharing, modification, decompilation, reverse engineering, or sharing or publishing a license key.
Unless otherwise stated on the product page, the license is granted without time limits for the purchased version. It may be terminated in case of a material breach of these terms.
8. Updates and support
Update terms are specified on each product page.
NeoGenys does not guarantee a specific update frequency or the indefinite availability of a product. If a product is discontinued, installed versions remain usable within the limits of Article 10.
Support is provided via the contact form, within a reasonable timeframe.
9. System requirements, third-party software, and compatibility
Buyers are responsible for ensuring their hardware and software setup matches the requirements listed on the product page before purchasing.
Some software relies on third-party products that are neither provided nor published by NeoGenys, and their purchase remains the buyer’s responsibility.
If software depends on interfaces published by third-party vendors, updates to those products may affect or interrupt functionality. NeoGenys strives to restore compatibility but cannot guarantee it.
10. Intended use and limitations
Each software is designed for the use described on its product page and no other.
Unless explicitly stated otherwise in writing, NeoGenys software is consumer-grade. It is not certified, designed, or intended for critical professional use, regulated activities, or applications involving the safety of people or property.
Some product pages include specific usage restrictions. These restrictions are part of these terms.
Any use outside the described scope is at the user’s sole risk.
11. Right of withdrawal
Under Article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where execution begins after the consumer’s express consent and explicit waiver of the right of withdrawal.
By confirming their order and accessing the download, the buyer expressly requests immediate execution and waives their right of withdrawal.
As long as the download has not been completed, the buyer retains a 14-day right of withdrawal.
12. Legal warranties
In addition to these terms, consumer buyers benefit from the legal warranty of conformity under Articles L217-1 and following of the French Consumer Code, as well as the warranty against hidden defects under Articles 1641 and following of the French Civil Code.
These warranties are exercised with the seller mentioned in Article 4. NeoGenys provides technical assistance for any requests related to software functionality.
13. Refunds
Refund requests are handled by Creem, the official seller, under its refund policy.
A product that does not function as described, after exchange with support and no resolution found, entitles the buyer to a refund under the legal warranties.
14. Liability
NeoGenys uses reasonable means to ensure its software functions correctly and that the information published on the website is accurate.
NeoGenys’ liability cannot be engaged for indirect damages or the consequences of non-compliance with these terms, unsuitable hardware or software setups, modifications made by the user, or changes to third-party products.
None of these terms limit NeoGenys’ liability in cases of fraud, gross negligence, or harm to physical integrity, nor do they deprive the consumer of their mandatory legal rights.
15. Intellectual property
The website, software, source code, interfaces, texts, visuals, and databases are protected by intellectual property law and remain the exclusive property of NeoGenys.
Any reproduction or representation, in whole or in part, without prior written authorization, is prohibited.
16. Third-party trademarks
Trademarks, names, and logos of third parties that may appear on the website or product pages belong to their respective owners.
They are mentioned solely to describe compatibility or intended use. NeoGenys is not affiliated, associated, authorized, or endorsed by any of these owners unless expressly stated.
17. Personal data
The processing of personal data is described in the privacy policy, accessible from the website.
Payment data is handled by Creem and does not pass through NeoGenys.
18. Changes to terms
NeoGenys may modify these terms at any time. The version applicable to an order is the one in force at the time of order confirmation.
19. Applicable law and disputes
These terms are governed by French law.
In case of a dispute, buyers are advised to contact NeoGenys via the contact form to seek an amicable resolution.
Under Articles L611-1 and following of the French Consumer Code, consumers may use a free consumer mediation service. They may also use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
If no amicable resolution is reached, French courts have jurisdiction, subject to consumer protection rules.
